1. In
terms of provisions of Section 86 (1) (b) of the Electricity Act, 2003 read
with the draft guidelines issued by the Honble
Himachal Pradesh Electricity Regulatory Commission,
hereinafter referred to as the Commission, the Himachal Pradesh State
Electricity Board,
hereinafter referred to as the Board had filed a
petition/application bearing No.1/2002(revised No.2/2002) with the Honble
commission,
seeking therein approval of the Model Power Purchase
Agreement, as applicable to the Hydro Electric Projects upto and including 5
MW
capacity being executed by the Independent Power Producers (IPPs)
in the Private Sector in the State of Himachal Pradesh.
- The
petition/application bearing No.1/2002 (Revised No.2/2002) has been
considered by the Honble Commission and certain

amendments have been suggested vide HPERC order dated 24.3.2003, out of
38 Modifications ordered by the HPERC, 35
-
modifications (S.No.1 to 12, 14 to 22 and 24 to 37) have been incorporated
in the PPA, 1 modification (Sr. No.38) being general,
- review
petition for remaining 2 modifications (Sr. No.13 and 23) as elaborated
hereunder have been separately filed with the
- Honble
Commission and it is prayed that the same be favourably considered while
deciding on this petition.

In this regard the commitment of GoHP is
required for which the matter stands referred to GoHP for conveying
decision with regard to making good the short fall in revenue
to the Board. Till the decision of the Govt., the Board may
be allowed to execute PPA on the basis of Article 6,
Clause 6.2 of the PPA |
