The Board shall be in loss if the rebate is
given at normal PLR of interest of S.B.I. Mostly PPAs executed elsewhere,
at Centre and State level provide for a fixed rebate on payments made with
in due date of the bill. This includes Baspa-II Project. The Central
Electricity Regulatory Commission also provides for fixed rebate provision
vide its notification dated 26.3.01 Chapter 2 clause 2.15, on payments
within due dates of the bill therefore the Board may be allowed to execute
the PPA on the basis of Article 8, Clause 8.2 of the PPA.

In terms of the provisions contained in the
draft guidelines framed by the Honble Commission, the Independent Power
Producers, hereinafter referred to as the IPP and the purchaser viz. the
Board can file the Power Purchase Agreement for the approval of the Honble
Commission. Such Power Purchase Agreement shall necessarily provide for
review meaning thereby that the Power Purchase Agreement so approved and
inked between the parties shall be subject to review following the
Commissions orders after enquiry and public hearings in case the Model Power
Purchase Agreement requires any modification or alteration.

The draft guidelines framed by the Honble
Commission, inter-alia, also provide that approval to such Power Purchase
Agreements shall be accorded within 15 days of the date of submission of the
petition strictly on the basis of the affidavits and the information
submitted by the IPP & Purchaser for which the parties will be themselves
responsible.
Accordingly the Power Purchase Agreement to be
executed by the parties here-to for sale of power by Patikari Hydro Power
Pvt. Ltd., to HPSEB for Patikari HEP (16 MW) is submitted to Honble
Commission for its approval.

6. The Project is at an advanced stage, and the
construction schedule is attached at Annexure F. All the required permits
for commencing construction have been obtained, save the forest clearance in
respect of which the necessary applications have been made and the necessary
clearance is expected to be obtained shortly. Memorandum of Understanding (MOU)
and Implementation Agreement (IA) for the implementation of the Project (16
MW) had been executed by the Government of Himachal Pradesh (GoHP) with M/s
East India Petroleum Ltd., Hyderabad on 21.06.2000 and 9.11.2001
