The Commission reserves the right to review and modify the provisions of the PPA. Such changes in the PPA, however shall have only the prospective effect.           

III.            FILING, WAIVER AND PRAYER 

16.            Keeping in view the limited purpose of this application filing, the Board has included limited number of schedules and attachments which generally conform to the requirements outlined by the Honble Commission in the draft guidelines.  The list of schedules and attachments (Annexures) is contained in the Table of Contents that precede the rest of the draft Power Purchase Agreement. 

17.       While filing the present application, the Board has followed the directions of the Honble Commission imparted in the shape of draft guidelines.  The Board reserves its right to avail of any better evidence and opportunities to substantiate and improve upon the present application permissible within the legal and regulatory frame work and the said directions/draft guidelines of the Honble Commission. 

18.       In the aforesaid facts and circumstances, the Board prays that the Honble Commission may graciously be pleased to:- 

            a)            Take the accompanying filing of Power Purchase Agreement on record; 

            b)         Consider and approve the Power Purchase Agreement; including request  for review of its order No.13 and 23 therein. 

            c)            Pass such orders as Honble Commission may deem fit, just and proper in  the facts and circumstances of the case.
